IS HACCP / ISO 22000 MANDATORY? WHAT BUSINESSES NEED TO KNOW

In the context of increasingly stringent food safety regulations, many businesses ask: Are HACCP or ISO 22000 mandatory? Or are they merely “passports” for export and marketing purposes? This article clarifies the legal nature of these standards, helping businesses avoid misinvestment and seize growth opportunities.

1. What are HACCP and ISO 22000?

HACCP (Hazard Analysis and Critical Control Points) is a food safety management system based on hazard analysis and critical control point monitoring.

ISO 22000 is an international standard that integrates HACCP principles with a comprehensive management system (including governance, traceability, and continual improvement).

👉 In simple terms:

- HACCP = Technical core of food safety

- ISO 22000 = HACCP + structured management system

2. Are HACCP / ISO 22000 legally mandatory?

Short answer:

- NOT 100% mandatory for all businesses

- HOWEVER, they are mandatory in many indirect cases

Food production processes in compliance with ISO 22000 and HACCP requirements

3. Legal updates – Decree 46/2026/ND-CP

According to Decree 46/2026/ND-CP (latest update on food safety management):

In the following cases, HACCP / ISO 22000 (or equivalent systems) are REQUIRED:

1 For establishments manufacturing medical nutrition products, foods for special dietary uses, dietary supplements, and nutritional products for children up to 36 months of age, it is required to apply certification of the Hazard Analysis and Critical Control Points (HACCP) system or the ISO 22000 Food Safety Management System or the International Featured Standards (IFS) or the British Retail Consortium (BRC) Global Standard for Food Safety or the Food Safety System Certification (FSSC 22000) or equivalent certification or a Certificate of eligibility for food safety conditions in compliance with Good Manufacturing Practices (GMP) in production and business activities from 31 December 2026.

Note: This decree is currently suspended pending the amended Food Safety Law.

=> Nevertheless, authorities still require hazard control systems in practice.

2 . Export businesses

Markets such as the EU, USA, Japan, and Korea…

=> HACCP is almost a prerequisite for market access

3. Supplying to supermarkets or large F&B chains

(e.g., AEON, Big C, WinMart…)

=> Certification is required by partners

4. High-risk food sectors

(e.g., processed food, frozen food, seafood, meat…)

=> Subject to stricter regulatory control

4. Why “not mandatory” still means “must implement”?

This is a common misunderstanding.

=> In reality:

- Legally: Not fully compulsory

- Commercially: Practically required

Examples

- No HACCP → Difficult to sign contracts with supermarkets

- No ISO 22000 → Limited export opportunities

- No system → High risk of penalties during inspectio

=> Conclusion: Not implementing HACCP means excluding your business from major market opportunities.

The implementation of ISO 22000/HACCP enables businesses to strengthen their credibility and meet stringent market requirements

5. HACCP vs ISO 22000 – Which should you choose?

HACCP is suitable for:

- Small and medium-sized enterprises (SMEs)

- Basic legal compliance

- Lower implementation cost

ISO 22000 is suitable for:

- Export-oriented businesses

- Working with large partners

- Long-term, structured management systems

6. Risks of not implementing HACCP / ISO 22000

Non-compliance penalties

Failure in customer audits

Loss of access to major supply chains

Product recalls (brand reputation damage)

7. Expert recommendation

From a professional consulting perspective:

-  Businesses should NOT ask: “Is it mandatory?”

- Instead, ask: “What will we lose if we do not implement it?”

🎯 Recommended strategy:

Step 1: Implement HACCP as a foundation

Step 2: Standardize and upgrade to ISO 22000

Step 3: For export → progress toward FSSC 22000

8. Conclusion

- HACCP / ISO 22000:

Not entirely mandatory by law

But almost mandatory in the marketplace

- Decree 46/2026/ND-CP reflects a clear trend:

  • Stricter control
  • Increased corporate responsibility
  • Alignment with international standards

📌 Recommendation:

If your business is:

  • Preparing for customer audits
  • Targeting supermarkets or export markets
  • Unsure where to start

=> Begin with HACCP / ISO 22000 Awareness & Internal Audit training to ensure the right direction from the outset.
